Licensing MySQL and InnoDB
Innobase Oy provides InnoDB exclusively to Sun/MySQL, which distributes and supports InnoDB within its product offerings. InnoDB is included under the open source GNU Public License (GPL) V2 in the MySQL Enterprise Server and is suitable for a broad range of users. The MySQL Community Edition, which is likewise is available in open source under the terms of the GPLv2, also includes InnoDB.
If you are an OEM or ISV, or otherwise want to use MySQL and InnoDB under a commercial license, you should check with Sun/MySQL. Also Sun/MySQL offers the MySQL Embedded Server 5.1 for OEMs and ISVs.

The GPLv2 License
The GNU General Public License version 2, under which both MySQL and InnoDB are published, does not allow, without permission from MySQL and Innobase, linking of InnoDB and MySQL, or the client libraries of MySQL, to a product which you distribute unless you also satisfy the requirements of the GPLv2 license, including publishing your source code.
If you want to combine MySQL and InnoDB to a product which you distribute, and which is not open source, you have to purchase a commercial license from MySQL. A commercial license does not require you to publish the source code of your application if you wish to distribute it.
